General conditions of use of the site

Terms of Use of Encherissez.com

These Terms of Use govern access to Encherissez.com and use of the services provided by EXPERTISEZ S.A.S.

The specific conditions applicable to each auction supplement these Terms of Use. In the event of a conflict concerning an auction, the specific conditions published for that auction will prevail.

1. Definitions

Catalogue A document presenting the lots offered in an auction, their photographs, descriptions, estimates and information applicable to the sale.
Conditions of Sale The specific conditions applicable to an auction, published in the catalogue or on the relevant platform.
Content Text, photographs, videos, catalogues, documents, data, links and other material available on the Website.
Telephone Bid A service allowing a previously accepted User to be called during an auction in order to bid by telephone.
Absentee Bid An instruction authorising the Auction Operator to bid on behalf of a User up to a stated maximum amount.
Auction Operator EXPERTISEZ S.A.S., a French voluntary auction operator declared to the Conseil des maisons de vente under number 068-2015.
Partner Platform A third-party digital service used to publish a catalogue, broadcast an auction or enable remote bidding.
Services The features accessible through the Website, including auction information, valuation requests and methods of bidding.
Website The website available at https://www.encherissez.com/.
User Any person who accesses the Website or uses any of its Services.
Live Auction An auction conducted live which may be broadcast through one or more platforms allowing remote bidding.
Online-Only Auction An auction conducted entirely online over a specified period.

2. Purpose and Acceptance

The Website allows Users to consult auction calendars and catalogues, access information about bidding and reach the valuation services offered by Expertisez Enchères.

Use of certain functions may require acceptance of these Terms of Use, the applicable Conditions of Sale and the Privacy Policy, including by means of a tick box.

Where a User is redirected to a Partner Platform, use of that platform is also governed by the terms and privacy policy of its operator.

A User who does not accept the applicable conditions must refrain from using the relevant Service.

3. Services

3.1. Valuation Requests

A User may submit a valuation request by completing the appropriate form and providing contact details, photographs, dimensions and any available information about the property.

A remote valuation constitutes an initial indication only. It may be revised following physical examination, additional research or consultation with a specialist.

Expertisez S.A.S. does not guarantee that a valuation can be provided for every request or that a submitted property will be accepted for sale.

3.2. Appointments and Inventories

A verbal valuation or physical examination may be arranged by appointment, subject to the arrangements announced by Expertisez S.A.S. Inventories, written appraisals and visits may be subject to a fee disclosed before the service is provided.

3.3. Auction Information

The Website allows Users to consult announced auctions, catalogues and information concerning individual lots. Published information may be corrected or supplemented before the auction, including by notices brought to the attention of bidders.

4. Absentee Bids and Telephone Bids

A User may request to submit an absentee bid or participate by telephone where these services are available for the auction concerned.

Requests must be received within the deadline announced for the auction. A late, incomplete or unconfirmed request may not be processed.

Identity verification The Auction Operator may request identification, proof of address and any information required to meet its regulatory obligations.
Financial guarantees A card authorisation, deposit or other guarantee may be requested before a bid is accepted.
Absentee bid The stated amount represents the maximum up to which the Auction Operator is authorised to bid for the User.
Telephone bid The request is subject to acceptance and to the technical and staffing capacity available during the auction.

The Auction Operator may refuse or be unable to process a request where the User’s identity or financial standing cannot be verified, information is incomplete, the lot has been amended or withdrawn, or available capacity has been reached.

Where two or more absentee bids have the same maximum amount, priority may be given to the bid received first.

Absentee and telephone bidding are offered as a convenience. Expertisez S.A.S. cannot guarantee that they will be free from error, communication failure or technical difficulty. Users who are able to do so are advised to bid directly in the saleroom or on the platform announced for the auction.

5. Payments and Guarantees

Accepted payment methods, any applicable limits, fees and conditions are stated in the specific Conditions of Sale and on the invoice.

Online payments may be processed by a separate payment-service provider. Card details are then collected and secured in accordance with that provider’s terms.

Expertisez S.A.S. may use strong customer authentication, including the 3D Secure protocol, where available or required.

A card authorisation, security deposit or proof of financial capacity does not constitute payment of the purchase price unless expressly stated otherwise.

Users must verify the authenticity of the bank details shown on their invoice. Any request to use different bank details must be confirmed directly with Expertisez S.A.S. before a transfer is made.

6. User Obligations

The User agrees to:

  • provide accurate, complete and up-to-date information;
  • use the Website in accordance with the law and these Terms;
  • not impersonate another person;
  • protect login credentials and payment methods;
  • not submit unlawful content or content infringing a third party’s rights;
  • use suitable equipment, an up-to-date browser and an adequate internet connection;
  • promptly inform Expertisez S.A.S. of any error affecting contact details or a bidding request.

Expertisez S.A.S. may refuse or suspend access to a Service, remove Content or refuse a bid in the event of a breach, insufficient information, suspected fraud or a regulatory obligation.

7. Personal Data

Expertisez S.A.S. processes data required for the operation of the Website, valuation requests, registrations, bidding, payments and compliance with its legal obligations.

The purposes, legal bases, recipients, retention periods and rights of data subjects are described in the Privacy Policy .

Cookies and similar technologies may be used in accordance with the preferences expressed by the User through the consent-management tool.

8. Intellectual Property

Unless otherwise stated, trademarks, logos, texts, photographs, videos, catalogues, descriptions, databases and other Content available on the Website are protected by intellectual-property law.

Any unauthorised reproduction, extraction, representation, adaptation or reuse, in whole or in part, is prohibited, subject to the exceptions provided by law.

A simple link to a public page of the Website is permitted provided that it does not create confusion regarding the source of the Content, does not use misleading embedding techniques and does not harm the reputation or rights of Expertisez S.A.S.

9. Availability and Liability

Expertisez S.A.S. takes reasonable steps to make the Website available. Access may nevertheless be interrupted or degraded because of maintenance, an update, a technical failure, network congestion or an external event.

Remote-bidding services depend in particular on the User’s connection, telecommunications networks and, where applicable, platforms operated by third parties.

Links to third-party websites and platforms are provided to facilitate access to certain services. Expertisez S.A.S. does not control their availability, content or contractual terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. In dealings with professional Users, Expertisez S.A.S. is not liable for indirect loss, subject to any mandatory legal provisions.

10. Amendments, Governing Law and Disputes

Amendments to the Terms

Expertisez S.A.S. may amend these Terms to reflect changes to the Website, its Services, service providers or applicable law. The applicable version is the version accepted or available when the relevant Service is used.

Mediation and Professional Complaints

In the event of a dispute concerning a voluntary public auction, any individual or legal entity may submit a complaint or request for mediation to the Government Commissioner attached to the French Conseil des maisons de vente by using the official complaint form .

Where a consumer mediator has jurisdiction, the mediator’s details will be provided to the consumer in accordance with Article L. 616-1 of the French Consumer Code following an unsuccessful complaint made directly to Expertisez S.A.S.

Governing Law

These Terms are governed by French law. Consumers retain the benefit of any mandatory jurisdiction and consumer-protection rules applicable to them.

In disputes between Expertisez S.A.S. and a professional User, and subject to any mandatory rules, the Paris Commercial Court shall have jurisdiction.

Severability and No Waiver

If any provision is declared invalid or unenforceable, the remaining provisions will remain in force. Failure to invoke a breach immediately does not constitute a waiver of the right to rely on that breach at a later date.

The previous version referred to the European Online Dispute Resolution Platform. This service was permanently discontinued on 20 July 2025 and the obsolete link has therefore been removed.
